Terms of Use

These Terms of Use (“Terms”) govern your use of the Current mobile application and website (the “Service”), operated by Colin Weaver (“we”, “us”). By using the Service you agree to these Terms.

1. Forecasts are informational only — the ocean is dangerous

Current provides surf and ocean condition forecasts generated by computational models. Forecasts are estimates, are frequently wrong, and must not be relied upon for decisions affecting safety. Ocean conditions can change rapidly and can differ substantially from any forecast. You alone are responsible for assessing actual conditions, your abilities, and the risks of entering the ocean. Never rely on the Service as a substitute for official warnings, lifeguard guidance, or your own judgment.

2. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, availability, merchantability, or fitness for a particular purpose. We do not warrant that forecasts will be correct or that the Service will be uninterrupted.

3. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages, or for any personal injury, death, or property damage, arising from your use of the Service or reliance on any forecast. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

4. Accounts

You may create an account to sync favorites and preferences. You are responsible for activity under your account. You may delete your account at any time in the app’s Settings, which permanently removes your account data from our servers.

5. Subscriptions

Optional premium features are offered as auto-renewing subscriptions purchased through Apple’s App Store. Payment is charged to your Apple account; subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings. Refunds are handled by Apple under Apple’s terms.

6. Acceptable use

You may not abuse, disrupt, reverse engineer, scrape at scale, or resell the Service or its data without permission.

7. Changes

We may update the Service and these Terms; material changes will be reflected by updating the effective date above. Continued use after changes constitutes acceptance.
